LAS VEGAS -- Tuesday, homeowners in a luxury high-rise on the Las Vegas Strip will decide the newest members of their HOA board. Though such elections don't normally make the news, this one raised eyebrows because of who's involved.

Last year, California developer Aaron Yashouafar was voted one of New York's 10 worst landlords. Just last month, Nevada regulators sanctioned him following allegations of missing millions from the Paradise Spa Homeowner's Association. Despite that action, sources say Yashouafar remains under investigation for his activities at the exclusive Sky Las Vegas condo complex.

Sky bills itself as the most desired address on Las Vegas Boulevard. It is a $325 million condo project marketed as an urban oasis by Yashouafar. Though he has made news nationwide, those reports are conspicuously absent from the press kit. Headlines like "New York's 10 Worst Landlords" must not appeal to luxury buyers.

"It's amazing that someone with his history has been able to just go from one deal to the next and keep pulling the wool over people's eyes," said Sky homeowner Brain Stone.

Brian Stone and Steve Plotkin both purchased investment properties at Sky in 2007, unaware until recently that Yashouafar retained control of the building through the property manager and the HOA.

"Four years after completion of the property, he's still there. And unfortunately, he was running things his way to his benefit and that cost us losses which are only now becoming public," said Plotkin.

Yashouafar, along with associates David Pourbaba and Homan Taghdiri, held a majority interest on the condo association's board of directors, despite delinquencies with their own HOA dues estimated at more than $1 million.

E-mails reveal an effort to remove the three earlier this year based on violations of the association's bylaws. Yet minutes from the March meeting show the three, who own some 80 units, refused to step down.
"The association is down to a small amount of cash in the bank. So when you've got that many units, homeowners dues not being paid, it puts a severe crimp in your cash flow," said Stone.

It is a scenario not unfamiliar to another Las Vegas condo complex -- Paradise Spa. Last month, the Nevada Real Estate Division sanctioned Yashouafar and Pouraba for multiple violations, including claims Yashouafar pocketed more than $800,000 in insurance proceeds from a fire at Paradise Spa.

As part of the settlement agreement, the two and their associates may not serve on any HOA boards in Nevada for three years. In compliance, Yashouafar and Pourbaba recently resigned from Sky Las Vegas. However sources say Taghiri, Yashouafar's corporate counsel, has not.

"We think the assets are there to make us whole. We're probably in better shape than the folks at the Spa because we do have capture assets," said Plotkin.

Recorder's records show the Sky HOA has liened the developer-owned properties and this week the homeowners will vote on a new board. Plotkin and Stone hope regime change will mean a new beginning for their luxury homes in the sky.

"We're optimistic we can get in and do the job that needs to be done that the developer refused to do," said Plotkin.

Sky HOA's attorney, along with Yashouafar, Pouraba and Taghiri did not respond to requests for comment. The new board's first order of business may well be a forensic audit of the property. Plotkin and Stone say it's unclear at this point whether funds have been misappropriated.

State and federal officials say they continue to investigate Yashouafar.

Aaron Yashouafar Under FBI CRIMINAL INVESTIGATION, Robert Paisola Reports

Clark County, NV (KTNV) - It's the latest chapter for homeowners and residents of Paradise Spa, which is a community of seniors and low income families on the south end of the Strip.

Chief Investigator Darcy Spears first inducted Paradise Spa into Contact 13's HOA Hall of Shame last year, and the state finally heard the case today.

Allegations of embezzlement and misappropriation of HOA funds led to a settlement agreement, but here's the catch.

It nets no money for homeowners.

But it is the first step toward long overdue accountability in a case where more than $2,000,000 is missing.

When you read the state's complaint against three former Paradise Spa board members, it seems they did nothing right.

They didn't hold meetings or properly conduct elections.

They kept their money in an unauthorized, out of state bank.

They owe about $1.5 million in unpaid HOA dues.

And they took more than a million dollars of insurance money for buildings burned in two separate fires... but never fixed anything and never accounted for the money.

"We have been damaged and it will take a long time to get back to where we need to be," said former State Senator Bill O'Donnell, Paradise Spa's new president.

He's been picking up the pieces left behind by Beverly Hills millionaire Aaron Yashouafar who is the former board treasurer and owns most of the Paradise Spa units.

We caught up with him for the first time at the Common Interest Community Commission hearing.

"What do you have to say to the Paradise Spa homeowners about where their money is?" asked Contact 13 Chief Investigator Darcy Spears.

Aaron: "No comment."

Darcy: "No comment at all? The Commission thinks these people have been badly harmed. Don't you think they deserve some answer from you about what you've done with the insurance money?"

Aaron: "They will get the answer in the proper procedures."

The answers will likely come in a courtroom as the FBI and Nevada Attorney General have an ongoing investigation into possible criminal activity regarding Paradise Spa's finances.

For now, the Nevada Real Estate Division has settled with Yashouafar and former board members Jim Pazargad and David Pourbaba for a total of $32,000 in fines and the promise not to serve on any HOA boards in Nevada for three years.

"We have taken the first step and we have won," O'Donnell said. "And we're gonna take step number two and hopefully we'll win there. And we're gonna continue and continue until this is solved and, basically, justice is done."




LAS VEGAS -- A man voted one of New York's 10 worst landlords has been sanctioned by Nevada regulators for his activities in Las Vegas.

For months, 8 News NOW has followed the struggles of homeowners at Paradise Spa. They say that Aaron Yashouafar misappropriated millions of dollars from their HOA.

According to the complaint by the Nevada Real Estate Division, Yashouafar served as the treasurer of the Paradise Spa HOA. He also owns the majority of units in the complex.

Yet Yashouafar and his associates, according to the complaint, failed to pay nearly $1 million in HOA fees for their properties and another $800,000 in insurance proceeds are missing.

Though Yashouafar denies the allegations against him, Tuesday he agreed to a deal with the Real Estate Division. Under its terms, Yashouafar and his associates are prevented from serving on any HOA boards for three years. In addition, Yashouafar must pay $22,000 in fines within 90 days.

Before approving the deal, members of the State Commission for Common-Interest Communities expressed their frustration with what some considered an inadequate remedy. However, current Paradise Spa board president Bill O'Donnell told commissioners his board approved of the settlement.

"There's plenty of money out there that has been either stolen or misappropriated or absconded with and we kind of know where that money is and we definitely plan on going and getting that," he said.

The HOA has filed a civil lawsuit against Yashouafar and a criminal investigation into his activities is on-going. Yashouafar declined to comment after the hearing.

We have just been informed by a senior employee that when the Board of Directors made the decision to replace all of the light-bulbs in the building that the replacement would be done in two stages.

The employees were required to account for all bulbs removed (All were accounted for) and then a kickback in the form of a REBATE would be provided to the SKY LAS VEGAS.

We now understand that phase one was completed and that nobody seems able to find the check for the 10,000 rebate?

Who cashed the check.

Folks it is fact that Board member LeVasseur was caught red handed, using her new secrecy policy, whereby she behind the backs of the SCSCAI residents was exchanging messages between herslf and Board member Cullen - - - copies sent to me by someone unknown!

Now we have in SCSCAI yet what seems like another controversy involving the new hire for the Executive Director position.    Now think clearly - - - -does anyone think that someone on the Board who has been caught red handed, discussing issues they want kept from the other Board members, kept from the residents, and as they said in those messages, even to keep data from their own legal counsel - - - are they to be believed - - - of course not!!!

With this type operation in writing, as I have said at the beginning of the Executive Director replacement process - - - - does anyone think the secrecy will stop, or can anyone think those using the secrecy policy will do what is best for SCSCAI???
Wake up folks - - - with LeVasseur and Cullen - - - -expect those to be favored possibly to be LeVasseur and Cullen, and possibly the he - -  with the Sun City Summerlin residents.

       These folks are harsh and not what should possibly be said - - -but this is what can be expected with how those two have operated!

"The committee members cannot answer your question. Since the process of interviews and selection of who we were sending to the board was closed. We could not even speak with board members prior to the board interviews so as not to taint them. The board would have to give you the information you seek. I don't know what is confidential as far as candidate information to the membership is or is not. They should discuss who they find most qualified at the meeting and why, that I know, but how much information we receive is questionable. UPDATE- We just received a confidential email that stated that Christine A. Gibbs , the "shoe in" candidate for the Summerlin Sun City ED Job HAS SUBMITTED HER RESIGNATION TO SKY LAS VEGAS. We were advised that this would be effective March 15, 2011.  .. So she is that sure that she has the job?  Thank God that we were able to get involved as MEDIA, even though  it is late in the game, to assist all of the great people at Sun City Summerlin.   Now if the residents revolt and stop the hiring process, she will have no job at SKY and no backup Job at Sun.  Oh, and we really want to interview the members of the board that approve this ED for a national news story on Corruption

I have read your stories on line concerning SKI Las Vegas and the alleged violation of laws by Prescott Mgt Co.
What you have claimed to have unearthed is but just the tip of a very large "cancer tumor" going on in the HOA "industry" not only in Las Vegas but in America!  With the assistance of Bob Robey and several others we have joined forces to fight the GIANT CAI who is driving the train and the Attorneys & management companies who represent the HOAs at homeowners expense. Let us not forget the collection companies involvement.
I have been waging my own Court fights and helping other owners in Clark County for several years. In the 2009 Legislative session we had a "Homeowners Bill of Rights " introduced by Assemblyman Harvey Munford know as AB 350. It would have  given homeowners back rights and leveled the playingfield. It was shot down for the most part but brought back in a completely different format.
This Session in 2011 we have several BDRs sponsored by both Assemblyman Munford & Senator Halseth. There are currently 15 Bills in the Legislature dealing with NRS116 statutes.
We are holding a RALLY on February 7th at 11:00 AM in front of the State Office building in Las Vegas..

SUN CITY BOARD ELECTION RECOMMENDATIONS 
Dear Fellow Sun City Owners:
     This is the most important letter I have written to you.  Our community is facing serious and multiple issues that will affect our future enjoyment of our lifestyle, our future costs of living here and our future enjoyment of the lifestyle we currently experience.  These are my opinions.  I encourage every Sun City owner to attend Board and Committee meetings and the opportunities to meet the Candidates such as the Residents' Forum meeting on January 12th.  Your Ballot is part of this month's LINK which most of you will have received when you get this letter.  Please vote as you wish but do it this week.  It's too easy to forget and misplace it.  Make up your mind-if you need to call me I'll be happy to answer questions.
There are 10 Candidates running for the Board and you can cast 5 Votes!  You can put all of your votes on one person or divide them up as you like-but you only have FIVE VOTES!  Please be careful and don't waste your votes.  The choices are very clear to me.  I personally know every person on your ballot-most for many years.  I also know background information that, as a non-board member, I really shouldn't know.  This is because there have been LEAKS of Confidential information by a member of the current Board of Directors. 
A director cannot decide what information should be confidential and what should not be confidential.  If a director believes the Board has violated NRS 116 there is a process he can take to correct the error.  There are some matters, especially personnel related, that, BY LAW, must remain Confidential. 
Mistakes have been made and there has been confusion (over many years and with many Boards) about what the Law (NRS 116) deems confidential, but there is NO EXCUSE  for a Board member to purposefully and willfully distribute and/or publish information that could give our insurance carrier justifiable cause to be relieved from having to cover an otherwise covered loss which could lead directly to our personal bank accounts!  The background of why our Executive Director is no longer here is murky at best.  The dysfuntionality (probably not a word) of our Board this past year has been embarrassing to say the least.
However, we must move forward.  Out of the ten Candidates I trust only five of them to work together with the remaining four (who are not up for election this year) in an honest effort to heal the wounds and to earnestly attend to their responsibilities to FOLLOW THE LAW and to distinguish between the information that BY LAW needs to be held Confidential and the information that MUST BE SHARED WITH THE MEMBERS (that is you and me). 
Dear Friends-it takes the quality of sanity and a very good I.Q. , a certain level of education and the ability to comprehend complex thoughts and, importantly, to control one's demeanor, temperament and behavior to fulfill the responsibility of representing the members of this community.  We deserve no less than respect and earnest care from our representatives...not behind-the-scenes falseness and childish actions.
I don't have enough space to detail all that I would like to say.  I need to get this letter to you today.  What I have said so far will have to be sufficient for you to know I make these recommendations based on knowledge of every person running as well as the Vote of the group of owners (Concerned Citizens) who met at the Highland Falls Clubhouse January 14th, listened to the Candidates who spoke, questioned them, discussed their views (after the Candidates left) and VOTED.
Their vote agrees with my own opinion which gives me extra confidence in the following recommendations. 
FRANK BEERS:Former 2004/05 Board member recently appointed to fill a vacancy. Frank has been serving our community since the day he moved in.  President of the Residents' Forum past five years, Chaired DREC and Reconstruction Committee.  He is a proven leader who works together and is tireless in his effort to keep Sun City "well" in every respect.  Smart and Loyal and knows the law, our history and our facilities.
GARY CONRATH: Director 2003/04, Chairman of Golf Oversight and IT committees, served on Golf Utilization, ARC, Finance & Reconstruction Committees.  He represents solid thinking and leadership. He is the example of what I consider to be the "ideal" Board Member.    
MARILYN LEVASSEUR: A current Board Member & President.  Chaired ARC, DREC and IT committees.  Led Golf Marketing sub-committee in recent successful improvements in golf revenue.  She worked diligently on the Restaurant Committee. She provided leadership (although not appreciated by some who are not aware of the actual facts and background) through the "mess" we are trying to (and must) clear up.
SUE PAPILION: Very smart.  Dedicated to Serving our community.  On her Sub-Association Board, Residents' Forum Board, drives for Security Patrol.  Stepped up to take the President's job for Two Bridge Clubs.  Huge Management background including Executive with Bullocks and Macy's.  Owned successful business, Tall Etc., with 13 stores, catalogue and Internet stores.  Volunteers for SCORE.  Good thinker!
BJ MARTENS: 
Worked with Properties and Community Preparedness Committees (CPC) The driving force providing leadership (and hard work) managing the CERT program.  Served on the Residents' Forum Board.  Earnest and very sensitive to owner's needs and problems.  She will be your "go to" Board member.

I've thought a lot whether I should elaborate on why I am not recommending the five remaining candidates.  I could say quite a lot about every one of them. The question I have asked myself is whether it would serve any purpose.  I think my introduction and strong recommendations should be sufficient!  Perhaps I will cover some of these issues in future newsletters. Here are the important issues of our community:
Open and Transparent Governance- This is a subject that must be deliberated and considered seriously.
Leaks: Terrible behavior by a Board Member which could cost us all dearly.
Hiring of New Executive Director and  Director of Human Relations Department. (Personnel to you and me).
Board Discord:  This MUST END!  Childish and retributive behavior must stop!  Adults only-Please!
Should Legal Opinions Should Be Released?  Are we getting the best Legal Opinions?  Is our current      representation inserting some comment or phrase into every opinion that makes it "confidential"????
What Can Be Done to improve the golf and food operations to make them more financially beneficial?  I wish they had just tried a good buffet with a great salad bar at a reasonable cost at the Summit Restaurant.  One special every day.  It's no mystery what type of menu/food is most popular in Sun City.  Why doesn't anyone listen to me??  What's your opinion?

Bruce:
I haven't seen the final Agenda nor the backup book. I do know they had another
extended Executive Session so one way or the other I am sure we will find out
whether they have made a decision. My position is that there is nothing secret
about hiring an ED but also agree it is Board business and is best done in
private. I believe that the information available like committee comments and
resumes are much better released to all. Arrogance can get us into a whole lot
of trouble.

The real problem is that this Board is not capable of making a sound judgment.
They would be much better off if they put off the final decision until the new
Board is in place.

Don Gelbman - Don as far as I know, choosing a Manager or Executive Director in SCSCAI does not have to be in an open session.   Though when the process is complete, most of what took place should be made public in an open meeting.  
Obviously personal data related to any of the individuals should be kept to the Board. 
I was on the Board when we hired, Harvey Hoffman and Barsky, and though not on the Board, when Winkel was hired I was involved, somewhat because I had met him prior to his coming to SCSCAI.   The Harvey Hoffman situation was comical.   Hoffman came for his interview when I was out of town, and when we as a Board voted I had to go by his resume.   The vote to hire was 8 no and myself the only yes.
At the time Bill Diveley was coming back to SCSCAI and the eight voted for Diveley, but having a Del Webb person was simply wrong, so I voted for Hoffman.   Then after the vote Diveley decided he did not want the position, so we had another vote for Hoffman, but in the interim I phoned where he had been employed, especially since he was asking literally for the moon.   Those I spoke with stated he was the worst there ever could be, informing me of several situations, and they ended the conversation with the statement saying - - - please take him!    Two days later the SCSCAI Board had the vote, and again I was on the outside looking in.   This time with much facts in my hand I voted no and the other eight voted to hire Hoffman. 
Needless to say he lasted only two years, until he filed a nine page charge against me, stating I had been threatening both residents and employees with a weapon.  
Obviously it was all lies, yet the Board supported his charges.   It was a mistake he made, for I was able to get him fired, primarily for what he had done.

     With this current seach for an ED, I can assure all that no one will be hired that LeVasseur cannot fully order around.    This is the way she operates, that being why she fired the HR Director.   She is obviously a control freak, who operates as we have proof, behing closed doors, and cannot because of that to be trusted.

        Thanks, and if you see LeVasseur give her my worst - - - er I mean my best!

I may be mistaken but.... no matter who is finally chosen to be our new ED, they must be licensed by the State.  Correct?  If they have a valid license then the Nevada RE Board has not taken an action against them, at least not a serious action.  If such occurs at some later date and their license is revoked, they can no longer act as our ED.  Is that correct?

What I don't understand is how anyone has the power to make all Directors and everyone else involved with the selection of Christine so afraid to speak up. Marilyn and Schulman do not have that power. I have been very vocal about all the situations with our Board and no one has threatened me. In fact the biggest problem is that no one will talk to me, I assume out of some kind of fear.

This is serious stuff coming at election time. No one can know who will be elected so why would anyone call a special meeting to be able to sign a contract with an ED when there will be a new Board in two weeks.

Subpoena Issued On Heels of Letter From Cestero To LNR Outlining Guiding Principles City Wants Debt Holder To Use In Soliciting Bids
New York, NY – NYC Department of Housing Preservation and Development (HPD) Commissioner Rafael E. Cestero today announced that the agency has issued a subpoena commanding the parties responsible for the Milbank portfolio of properties in the Bronx to appear at HPD headquarters on January 11, 2011 to answer questions about the ownership, management and maintenance of the buildings. The properties at issue are 10 occupied rental buildings in the Bronx, now in foreclosure, whose tenants continue to suffer deplorable living conditions that range from vermin and mold infestations to cascading leaks, collapsing ceilings, inoperable elevators and missing locks on building entrances despite the presence of a Court-ordered receiver charged with making repairs.


“In late October I toured three of these properties because I had to see for myself what I was hearing from our Code enforcement staff,” said Commissioner Cestero. “To say I was disturbed and disgusted by what I saw is an understatement. Not only are these buildings clearly suffering from years of neglect, but the families who call them home have endured indecent hardships. I ordered cellar-to-roof inspections of all 10 properties. As a result, we have issued 1,579 new Housing Code violations, bringing the total to 4,372 violations. HPD’s goal in taking the extraordinary step of using our subpoena powers is to learn first-hand why tenants are still living in these deplorable conditions and violations are continuing to climb.”


The Commissioner’s overriding concern is seeing that Consolato Cicciu, the appointed receiver charged with the responsibility of maintaining the properties and fixing violations, has the necessary financial resources to do the job. Given the mounting violations and deteriorating conditions the tenants are being forced to live in, it was necessary to subpoena both LNR and Milbank in order to gain access to information regarding income, operating expenses and other financial data, along with correspondence between the two parties to track the money and ensure that it is going toward building maintenance needs. Likewise, Mr. Cicciu is being subpoenaed in order to better understand what resources are available and how they are being used. He is asked to produce documents related to the maintenance that has been performed, the outstanding needs of the portfolio and resources available to meet those needs. 

 
 “I want to commend Department of Housing Preservation Development Commissioner Cestero today for taking this legal action,” said Speaker Christine C. Quinn. “It is another indicator that working with the City Council, HPD is proactively helping tenants living in the Milbank buildings. I’m proud to say that this action has come out of the coordination of the Task Force on Financially Distressed Rental Housing. And with today’s subpoenas, we are one step closer to getting our residents the relief they deserve so they don’t have to live in these dangerous and atrocious conditions. The message here to LNR, Milbank and other irresponsible banks is clear: As long as you unfairly mistreat our New York tenants, the City of New York will do everything in its power to fight back.”

 
The Task Force on Financially Distressed Rental Housing – a collaborative effort with the New York City Council, HPD, and housing experts – has been working on Milbank for the past year. 


Speaker Quinn and the New York City Council has been closely working with tenants for months, putting constant pressure on the servicer LNR to make repairs on these 10 overleveraged buildings.

Larry Golinsky, Vice President of LNR Partners Inc, the company that now holds the mortgage for the properties and which is seeking to dispose of it to new owners; Aaron Yashouafar and Solyman Yashouafar of California-based Milbank Real Estate, which defaulted on the mortgage; and Mr. Cicciu, the appointed Receiver for the properties, were all named in the subpoena, and are required to testify in person or by designee in front of a hearing board convened by the Commissioner.


This subpoena comes on the heels of a letter sent by Commissioner Cestero to Thomas J. Hughes, LNR’s Chairman and CEO, which outlined his concerns and strongly urged Mr. Hughes to follow a set of guiding principles when soliciting bids on the portfolio.


The December 3rd letter referred to the conditions of the buildings as “disgraceful,” and in no uncertain terms stated that HPD holds LNR and Milbank, “responsible for the current conditions in which the tenants are living.” He reminded LNR that HPD has provided them a preapproved list of owners qualified to manage distressed properties, and that the agency would make its rehabilitation financing programs available to an HPD-approved purchaser. The Commissioner also urged the Chairman and CEO of LNR to follow several guidelines when bidding out the package including:
  • Only considering bids from developers qualified to turn around distressed rental housing.
  • Bidders should be able to access all common and mechanical areas and a significant portion of occupied units as part of their due diligence.
  • The new buyer should have a plan to immediately repair the hazardous violations.
  • HPD should have the ability to review the rehabilitation plan before the deal is closed. 
Last month, Commissioner Cestero and City Council Speaker Christine Quinn announced that despite being able to gain access to fewer than half of the occupied units, HPD’s ongoing proactive cellar-to-roof inspections of the 10 building portfolio produced 1,245 new violations. HPD logged 243 new Class A, 823 new Class B, and 179 new Class C violations. Commissioner Cestero reminds tenants that to request an inspection and to report any concerns over housing conditions they should call 311.


California based Milbank Real Estate purchased the rent stabilized properties in 2007, and ultimately defaulted on the $35 million mortgage. Already in a state of distress, the condition of the buildings rapidly declined under Milbank’s watch, leaving the tenants to suffer in deplorable and hazardous living conditions. In March of 2009, the mortgage holder, a $3.78 billion commercial mortgage-backed security trust controlled by Wells Fargo and serviced by LNR Partners, Inc., initiated foreclosure proceedings. HPD, the Council Speaker’s office, and housing advocates all voiced their strong concerns about LNR’s plans to sell the property to an undisclosed bidder. In addition to pushing LNR to make the badly needed repairs, they called on the servicer to find a responsible owner with a proven track record of managing distressed properties. After the attempt to sell the portfolio failed, LNR enlisted real estate firm Massey Knakal to market the portfolio. The first bids from prospective buyers are reportedly due back soon.

 Is our Master Meter Legal? Absolutely Not, This is a criminal Matter and Any person who has paid Sky Las Vegas for Utilities since the facility was opened is a victim, renter or owner, you will be represented in a criminal action against the Conspirators.

NAC 704.560  Restricted use of master meters. (NRS 703.025, 704.210)


     1.  Except as otherwise provided in subsection 2, the use of a master meter for a new building is prohibited if:

     (a) The building has more than one unit;

     (b) The occupant of each unit controls a portion of the electric energy used in the building; and

     (c) The long-run benefits of separate metering outweigh the costs of purchasing and installing separate meters.

     2.  Master metering is not prohibited if a new building is initially constructed as one unit and is later subdivided into several units and if the utility determines that individual metering of each unit is impractical or impossible.

     3.  A customer who desires to have a master meter installed in a new building has the burden of proving to the utility that master metering for the building should not be prohibited. If the customer is not satisfied with the utility's determination on the matter, he may file a complaint against the utility with the Commission pursuant to the Rules of Practice and Procedure before the Commission.

     4.  The utility shall file with the Commission and provide each customer who requests the installation of a master meter a written statement of the criteria which the utility uses in evaluating such a request.

The Sky Condom
iniums are master metered by NPC (Nevada Power) under rate schedule LGS-2 Primary and charges $291/month customer charge to the HOA which is paid by the owners in our HOA fees (average $.71/unit). The building's rates vary drastically by time and season. We are also charged demand fees as a commercial or industrial facility would be charged. We have 409 residential units and a few commercial spaces most of which are vacant. The master meter includes all building usage. Each owned unit has a separate meter to track that residents usage. The owners also pay their pro-rated share of the common area usage (hallways, cooling towers, lobby, etc.) based on the size of their unit.

AMPS (Accurate Metering Products, CA) reads the submeters at a cost to the HOA of 4400/month (Average ~$10/unit/month) - which is paid by the owners in our HOA fees. Each owner receives a monthly bill from AMPS for their individual usage, and is again charged a $17.10 NPC Customer charge - on top of the metering & NPC fees paid in our HOA fees. AMPS uses an NPC small commercial rate schedule that carries that fee in order to bill the owners. Sky owners are not customers of NPC, so this is a bogus charge imposed by AMPS and our HOA. The price for electrical consumption in KWHR is passed thru to the owners at the same rate as charged by NPC to the building (this part is OK).

It Gets Worse... The sum of all the demand charges imposed on individual owners is GREATER than the demand charged to the building. The reason for this is complicated, but it's due to "Demand Diversity". The net result is the HOA profits nicely from these additional demand and facility charges imposed on the owners.

BOTTOM LINE
