Elder abuse is a general term used to describe certain types of harm to older adults. Other terms commonly used include: "elder mistreatment", "senior abuse", "abuse in later life", "abuse of older adults", "abuse of older women", and "abuse of older men".
One of the more commonly accepted definitions of elder abuse is "a single, or repeated act, or lack of appropriate action, occurring within any relationship where there is an expectation of trust which causes harm or distress to an older person."[1] This definition has been adopted by the World Health Organization from a definition put forward by Action on Elder Abuse in the UK.
The core feature of this definition is that it focuses on harms where there is "expectation of trust" of the older person toward their abuser. Thus it includes harms by people the older person knows or with whom they have a relationship, such as a spouse, partner or family member, a friend or neighbor, or people that the older person relies on for services. Many forms of elder abuse are recognized as types of domestic violence or family violence.
The term elder abuse does not include general criminal activity against older persons, such as home break ins, "muggings" in the street or "distraction burglary", where a stranger distracts an older person at the doorstep while another person enters the property to steal.
In 2006 the [International Network for Prevention of Elder Abuse (INPEA)] designated June 15 as World Elder Abuse Awareness Day (WEAAD) and an increasing number of events are held across the globe on this day to raise awareness of elder abuse, and highlight ways to challenge such abuse.[2]

Although there are common themes of elder abuse across nations, there are also unique manifestations based upon history, culture, economic strength and societal perceptions of older people within nations themselves. The fundamental common denominator is the use of power and control by one individual to affect the well-being and status of another, older, individual.
There are several types of abuse of older people that are generally recognized as being elder abuse, including:
  • Physical: e.g. hitting, punching, slapping, burning, pushing, kicking, restraining, false imprisonment/confinement, or giving excessive or improper medication
  • Psychological/Emotional: e.g. shouting, swearing, frightening, or humiliating a person. A common theme is a perpetrator who identifies something that matters to an older person and then uses it to coerce an older person into a particular action. It may take verbal forms such as name-calling, ridiculing, constantly criticizing, accusations, blaming, and general disrespect, or non verbal forms such as ignoring, silence or shunning.
  • Financial abuse: also known as financial exploitation. e.g. illegal or unauthorized use of a person’s property, money, pension book or other valuables (including changing the person's will to name the abuser as heir). It may be obtained by deception, coercion, misrepresentation, or theft. The term includes fraudulently obtaining or use of a power of attorney. Other forms include deprivation of money or other property, or by eviction from own home
  • Sexual: e.g. forcing a person to take part in any sexual activity without his or her consent, including forcing them to participate in conversations of a sexual nature against their will; may also include situations where person is no longer able to give consent (dementia)
  • Neglect: e.g. depriving a person of food, heat, clothing or comfort or essential medication and depriving a person of needed services to force certain kinds of actions, financial and otherwise. The deprivation may be intentional (active neglect) or happen out of lack of knowledge or resources (passive neglect).
In addition, some U.S. state laws [3] also recognize the following as elder abuse:
  • Rights abuse: denying the civil and constitutional rights of a person who is old, but not declared by court to be mentally incapacitated. This is an aspect of elder abuse that is increasingly being recognised and adopted by nations
  • Self-neglect: elderly persons neglecting themselves by not caring about their own health or safety. Self neglect ( harm by self) is treated as conceptually different than abuse (harm by others).
  • 'Abandonment': deserting a dependent person with the intent to abandon them or leave them unattended at a place for such a time period as may be likely to endanger their health or welfare.[4]
Institutional abuse refers to physical or psychological harms, as well as rights violations in settings where care and assistance is provided to dependant older adults or others.

[edit] Signs

The signs of abuse vary considerably among older people and with the type of harm being experienced. An older person who is being abused may:
  • Say she or he is being harmed
  • Seem depressed and withdrawn; signs of depression in elders are not getting dressed, not performing basic care of themselves that they are able to do, never going out even if they can, inability to sleep or sleeping too much
  • Not accepting invitations to spend time away from their family or a caregiver
  • Seem afraid to make their own decisions
  • Seem to be hiding something about a caregiver
  • Not have any spending money
  • Put off going to the doctor
  • Feel anxious and fearful
  • Try to "run away," leaving their place of residence and not wishing to return
  • Seem to have too many household "accidents"[5]
Any of these potential signs can indicate problems other than abuse or neglect, and none of these "proves" there is harms occurring. The presence of the signs simply indicate that further inquiry may be necessary.

[edit] Common abusers of older people

An abuser can be a spouse, partner, relative, a friend or neighbor, a volunteer worker, a paid worker, practitioner, solicitor or any other individual with the intent to deprive a vulnerable person of their resources. Relatives include adult children and their spouses or partners, their offspring and other extended family members. Children and living relatives who have a history of substance abuse or have had other life troubles are of particular concern.
Perpetrators of elder abuse can include anyone in a position of trust, control or authority. Family relationships, neighbours and friends, are all socially considered as relationships of trust, whether or not the older adult actually thinks of the people as "trustworthy". Some perpetrators may "groom" an older person (befriend or build a relationship with them) in order to establish a relationship of trust. Older people living alone who have no adult children living nearby are particularly vulnerable to "grooming" by neighbors and friends who would hope to gain control of their estates.
The majority of abusers are relatives, typically the older adult's spouse/partner or sons and daughters, although the type of abuse differs according to the relationship. In some situations the abuse is "domestic violence grown old", a situation in which the abusive behaviour of a spouse or partner continues into old age.
In some situations, an older couple may be attempting to care and support each other and failing, in the absence of external support. With sons and daughters it tends to be financial abuse, justified by a belief that it is nothing more than the "advance inheritance" of property, valuables and money.
Within paid care environments, abuse can occur for a variety of reasons. Some abuse is the willful act of cruelty inflicted by a single individual upon an older person. In fact, a case study in Canada suggests that the high elder abuse statistics are from repeat offenders who, like in other forms of abuse, practice elder abuse for the schadenfreude associated with the act. Nick Klassen, a practitioner of elder abuse involved in the study, described somewhat of an ecstasy, high, or sense of satisfaction while performing acts of abuse on the elderly. More commonly, institutional abuses or neglect may reflect lack of knowledge, lack of training, lack of support, or insufficient resourcing. Institutional abuse may be the consequence common practices or processes that are part of running of a care institution or service. Sometimes this type of abuse is referred to as "poor practice", although it is important to recognise that this term reflects the motive of the perpetrator (the causation) rather than the impact upon the older person.
With the aging of today's population, there is the potential that elder abuse will increase unless it is more comprehensively recognised and addressed.

[edit] Abuse statistics

There has been a general lack of reliable data in this area and it is often argued that the absence of data is a reflection of the low priority given to work associated with older people. However, over the past decade there has been a growing amount of research into the nature and extent of elder abuse. The research still varies considerably in the definitions being used, who is being asked and what is being asked. As a result, the statistics used in this area vary considerably.
One study suggests that around 25% of vulnerable older adults will report abuse in the previous month, totaling up to 6% of the general elderly population.[6] However, some consistent themes are beginning to emerge from interaction with abused elders, and through limited and small scale research projects. Work undertaken in Canada suggests that approximately 70% of elder abuse is perpetrated against women, and this is supported by evidence from the AEA helpline in the UK which identifies women as victims in 67% of calls. Also domestic violence in later life may be a continuation of long term partner abuse and, in some cases, abuse may begin with retirement or the onset of a health condition.[7] Certainly, abuse increases with age, with 78% of victims being over 70 years of age.[8]
The higher proportion of spousal homicides supports the suggestion that abuse of older women is often a continuation of long term spousal abuse against women. In contrast, the risk of homicide for older men was far greater outside the family than within.[9] This is an important point because the domestic violence of older people is often not recognized, and consequently strategies which have proved effective within the domestic violence arena have not been routinely transferred into circumstances involving the family abuse of older people.
According to the AEA helpline in the UK, abuse occurs primarily in the family home (64%), followed by residential care (23%) and then hospitals (5%), although a helpline does not necessarily provide a true reflection of such situations as it is based upon the physical and mental ability of people to utilize such a resource.[8]

Elder abuse can also include deserting an elderly, dependent person with the intent to abandon them or leave them unattended at a place for such a time period as may be likely to endanger their health or welfare.[4]

[edit] Self-abuse and neglect

Older adults may neglect themselves by not taking care of or caring about their own personal health and well-being.[10] Elder self-neglect can lead to illness, injury or even death. Common needs that the older adult may deny themselves or ignore are the following:
  • Sustenance (food or water)
  • Cleanliness (bathing and personal hygiene)
  • Adequate clothing for climate protection
  • Proper shelter
  • Adequate safety
  • Clean and healthy surroundings
  • Medical attention for serious illness
  • Essential medications
Self neglect is often created by an individual's declining mental awareness or capability.
Some older adults may choose to deny themselves some health or safety benefits, which may not be self-neglect. This may simply be their personal choice. Caregivers and other responsible individuals must honor these choices if the older adult is sound of mind. In other instances, the older adult may lack the needed resources, as a result of poverty or other social condition. This is also not considered as "self neglect".

Research conducted in New Zealand broadly supports the above findings, with some variations. Of 1288 cases in 2002–2004, 1201 individuals, 42 couples and 45 groups were found to have been abused. Of these, 70 percent were female. Psychological abuse (59%), followed by material/financial (42%) and physical abuse (12%) were the most frequently identified types of abuse. Sexual abuse occurred in 2 percent of reported cases.[11]
Age Concern New Zealand found that most abusers are family members (70%), most commonly sons or daughters (40%). Older abusers (those over 65 years) are more likely to be husbands.[11]
In 2007 4,766 cases of suspected abuse, neglect, or financial exploitation involving older adults were reported, an increase of 9 percent over 2006. Tragically, 19 incidents were related to a death, and a total of 303 incidents were considered life-threatening. About one in 11 incidents involved a life-threatening or fatal situation.

For those over the age of 60, help is available through local Area Agencies on Aging (AAA) that include older adult protective services as an important component of their aging services. The phone number for local AAA offices can be found in the phone book blue pages under Abuse/Assault.[5]
National Center on Elder Abuse The National Center on Elder Abuse (NCEA) serves as a national resource center dedicated to the prevention of elder mistreatment. First established by the U.S. Administration on Aging (AoA) in 1988 as a national elder abuse resource center, the NCEA was granted a permanent home at AoA in the 1992 amendments made to Title II of the Older Americans Act.
National Committee for the Prevention of Elder Abuse (NCPEA) The National Committee for the Prevention of Elder Abuse is an association of researchers, practitioners, educators, and advocates dedicated to protecting the safety, security, and dignity of America’s most vulnerable citizens. It was established in 1988 to achieve a clearer understanding of abuse and provide direction and leadership to prevent it.

Folks it is fact that Board member LeVasseur was caught red handed, using her new secrecy policy, whereby she behind the backs of the SCSCAI residents was exchanging messages between herslf and Board member Cullen - - - copies sent to me by someone unknown!

Now we have in SCSCAI yet what seems like another controversy involving the new hire for the Executive Director position.    Now think clearly - - - -does anyone think that someone on the Board who has been caught red handed, discussing issues they want kept from the other Board members, kept from the residents, and as they said in those messages, even to keep data from their own legal counsel - - - are they to be believed - - - of course not!!!

With this type operation in writing, as I have said at the beginning of the Executive Director replacement process - - - - does anyone think the secrecy will stop, or can anyone think those using the secrecy policy will do what is best for SCSCAI???
Wake up folks - - - with LeVasseur and Cullen - - - -expect those to be favored possibly to be LeVasseur and Cullen, and possibly the he - -  with the Sun City Summerlin residents.

       These folks are harsh and not what should possibly be said - - -but this is what can be expected with how those two have operated!

"The committee members cannot answer your question. Since the process of interviews and selection of who we were sending to the board was closed. We could not even speak with board members prior to the board interviews so as not to taint them. The board would have to give you the information you seek. I don't know what is confidential as far as candidate information to the membership is or is not. They should discuss who they find most qualified at the meeting and why, that I know, but how much information we receive is questionable. UPDATE- We just received a confidential email that stated that Christine A. Gibbs , the "shoe in" candidate for the Summerlin Sun City ED Job HAS SUBMITTED HER RESIGNATION TO SKY LAS VEGAS. We were advised that this would be effective March 15, 2011.  .. So she is that sure that she has the job?  Thank God that we were able to get involved as MEDIA, even though  it is late in the game, to assist all of the great people at Sun City Summerlin.   Now if the residents revolt and stop the hiring process, she will have no job at SKY and no backup Job at Sun.  Oh, and we really want to interview the members of the board that approve this ED for a national news story on Corruption

Dear Sir,
I have read your stories on line concerning SKI Las Vegas and the alleged violation of laws by Prescott Mgt Co.
What you have claimed to have unearthed is but just the tip of a very large "cancer tumor" going on in the HOA "industry" not only in Las Vegas but in America!  With the assistance of Bob Robey and several others we have joined forces to fight the GIANT CAI who is driving the train and the Attorneys & management companies who represent the HOAs at homeowners expense. Let us not forget the collection companies involvement.
I have been waging my own Court fights and helping other owners in Clark County for several years. In the 2009 Legislative session we had a "Homeowners Bill of Rights " introduced by Assemblyman Harvey Munford know as AB 350. It would have  given homeowners back rights and leveled the playingfield. It was shot down for the most part but brought back in a completely different format.
This Session in 2011 we have several BDRs sponsored by both Assemblyman Munford & Senator Halseth. There are currently 15 Bills in the Legislature dealing with NRS116 statutes.
We are holding a RALLY on February 7th at 11:00 AM in front of the State Office building in Las Vegas..

SUN CITY BOARD ELECTION RECOMMENDATIONS 
Dear Fellow Sun City Owners:
     This is the most important letter I have written to you.  Our community is facing serious and multiple issues that will affect our future enjoyment of our lifestyle, our future costs of living here and our future enjoyment of the lifestyle we currently experience.  These are my opinions.  I encourage every Sun City owner to attend Board and Committee meetings and the opportunities to meet the Candidates such as the Residents' Forum meeting on January 12th.  Your Ballot is part of this month's LINK which most of you will have received when you get this letter.  Please vote as you wish but do it this week.  It's too easy to forget and misplace it.  Make up your mind-if you need to call me I'll be happy to answer questions.
There are 10 Candidates running for the Board and you can cast 5 Votes!  You can put all of your votes on one person or divide them up as you like-but you only have FIVE VOTES!  Please be careful and don't waste your votes.  The choices are very clear to me.  I personally know every person on your ballot-most for many years.  I also know background information that, as a non-board member, I really shouldn't know.  This is because there have been LEAKS of Confidential information by a member of the current Board of Directors. 
A director cannot decide what information should be confidential and what should not be confidential.  If a director believes the Board has violated NRS 116 there is a process he can take to correct the error.  There are some matters, especially personnel related, that, BY LAW, must remain Confidential. 
Mistakes have been made and there has been confusion (over many years and with many Boards) about what the Law (NRS 116) deems confidential, but there is NO EXCUSE  for a Board member to purposefully and willfully distribute and/or publish information that could give our insurance carrier justifiable cause to be relieved from having to cover an otherwise covered loss which could lead directly to our personal bank accounts!  The background of why our Executive Director is no longer here is murky at best.  The dysfuntionality (probably not a word) of our Board this past year has been embarrassing to say the least.
However, we must move forward.  Out of the ten Candidates I trust only five of them to work together with the remaining four (who are not up for election this year) in an honest effort to heal the wounds and to earnestly attend to their responsibilities to FOLLOW THE LAW and to distinguish between the information that BY LAW needs to be held Confidential and the information that MUST BE SHARED WITH THE MEMBERS (that is you and me). 
Dear Friends-it takes the quality of sanity and a very good I.Q. , a certain level of education and the ability to comprehend complex thoughts and, importantly, to control one's demeanor, temperament and behavior to fulfill the responsibility of representing the members of this community.  We deserve no less than respect and earnest care from our representatives...not behind-the-scenes falseness and childish actions.
I don't have enough space to detail all that I would like to say.  I need to get this letter to you today.  What I have said so far will have to be sufficient for you to know I make these recommendations based on knowledge of every person running as well as the Vote of the group of owners (Concerned Citizens) who met at the Highland Falls Clubhouse January 14th, listened to the Candidates who spoke, questioned them, discussed their views (after the Candidates left) and VOTED.
Their vote agrees with my own opinion which gives me extra confidence in the following recommendations. 
FRANK BEERS:Former 2004/05 Board member recently appointed to fill a vacancy. Frank has been serving our community since the day he moved in.  President of the Residents' Forum past five years, Chaired DREC and Reconstruction Committee.  He is a proven leader who works together and is tireless in his effort to keep Sun City "well" in every respect.  Smart and Loyal and knows the law, our history and our facilities.
GARY CONRATH: Director 2003/04, Chairman of Golf Oversight and IT committees, served on Golf Utilization, ARC, Finance & Reconstruction Committees.  He represents solid thinking and leadership. He is the example of what I consider to be the "ideal" Board Member.    
MARILYN LEVASSEUR: A current Board Member & President.  Chaired ARC, DREC and IT committees.  Led Golf Marketing sub-committee in recent successful improvements in golf revenue.  She worked diligently on the Restaurant Committee. She provided leadership (although not appreciated by some who are not aware of the actual facts and background) through the "mess" we are trying to (and must) clear up.
SUE PAPILION: Very smart.  Dedicated to Serving our community.  On her Sub-Association Board, Residents' Forum Board, drives for Security Patrol.  Stepped up to take the President's job for Two Bridge Clubs.  Huge Management background including Executive with Bullocks and Macy's.  Owned successful business, Tall Etc., with 13 stores, catalogue and Internet stores.  Volunteers for SCORE.  Good thinker!
BJ MARTENS:

I've thought a lot whether I should elaborate on why I am not recommending the five remaining candidates.  I could say quite a lot about every one of them. The question I have asked myself is whether it would serve any purpose.  I think my introduction and strong recommendations should be sufficient!  Perhaps I will cover some of these issues in future newsletters. Here are the important issues of our community:
Open and Transparent Governance- This is a subject that must be deliberated and considered seriously.
Leaks: Terrible behavior by a Board Member which could cost us all dearly.
Hiring of New Executive Director and  Director of Human Relations Department. (Personnel to you and me).
Board Discord:  This MUST END!  Childish and retributive behavior must stop!  Adults only-Please!
Should Legal Opinions Should Be Released?  Are we getting the best Legal Opinions?  Is our current      representation inserting some comment or phrase into every opinion that makes it "confidential"????
What Can Be Done to improve the golf and food operations to make them more financially beneficial?  I wish they had just tried a good buffet with a great salad bar at a reasonable cost at the Summit Restaurant.  One special every day.  It's no mystery what type of menu/food is most popular in Sun City.  Why doesn't anyone listen to me??  What's your opinion?

Bruce:
I haven't seen the final Agenda nor the backup book. I do know they had another
extended Executive Session so one way or the other I am sure we will find out
whether they have made a decision. My position is that there is nothing secret
about hiring an ED but also agree it is Board business and is best done in
private. I believe that the information available like committee comments and
resumes are much better released to all. Arrogance can get us into a whole lot
of trouble.

The real problem is that this Board is not capable of making a sound judgment.
They would be much better off if they put off the final decision until the new
Board is in place.

Don Gelbman - Don as far as I know, choosing a Manager or Executive Director in SCSCAI does not have to be in an open session.   Though when the process is complete, most of what took place should be made public in an open meeting.  
Obviously personal data related to any of the individuals should be kept to the Board. 
I was on the Board when we hired, Harvey Hoffman and Barsky, and though not on the Board, when Winkel was hired I was involved, somewhat because I had met him prior to his coming to SCSCAI.   The Harvey Hoffman situation was comical.   Hoffman came for his interview when I was out of town, and when we as a Board voted I had to go by his resume.   The vote to hire was 8 no and myself the only yes.
At the time Bill Diveley was coming back to SCSCAI and the eight voted for Diveley, but having a Del Webb person was simply wrong, so I voted for Hoffman.   Then after the vote Diveley decided he did not want the position, so we had another vote for Hoffman, but in the interim I phoned where he had been employed, especially since he was asking literally for the moon.   Those I spoke with stated he was the worst there ever could be, informing me of several situations, and they ended the conversation with the statement saying - - - please take him!    Two days later the SCSCAI Board had the vote, and again I was on the outside looking in.   This time with much facts in my hand I voted no and the other eight voted to hire Hoffman. 
Needless to say he lasted only two years, until he filed a nine page charge against me, stating I had been threatening both residents and employees with a weapon.  
Obviously it was all lies, yet the Board supported his charges.   It was a mistake he made, for I was able to get him fired, primarily for what he had done.

     With this current seach for an ED, I can assure all that no one will be hired that LeVasseur cannot fully order around.    This is the way she operates, that being why she fired the HR Director.   She is obviously a control freak, who operates as we have proof, behing closed doors, and cannot because of that to be trusted.

I may be mistaken but.... no matter who is finally chosen to be our new ED, they must be licensed by the State.  Correct?  If they have a valid license then the Nevada RE Board has not taken an action against them, at least not a serious action.  If such occurs at some later date and their license is revoked, they can no longer act as our ED.  Is that correct?

If you didn't approve him how did he join? I got a couple of emails addressed to me that had a string from Passmonick and Silver attached. I am familiar with the allegations as is everyone since they have been posted on both chat lines.

What I don't understand is how anyone has the power to make all Directors and everyone else involved with the selection of Christine so afraid to speak up. Marilyn and Schulman do not have that power. I have been very vocal about all the situations with our Board and no one has threatened me. In fact the biggest problem is that no one will talk to me, I assume out of some kind of fear.

This is serious stuff coming at election time. No one can know who will be elected so why would anyone call a special meeting to be able to sign a contract with an ED when there will be a new Board in two weeks.

Today marked a historic day for residents of the State of Nevada.  For the first time EVER, the Nevada Public Utilities Commission in association with The State of Nevada Office of Attorney General came together to look at a Criminal Conspiracy against the Residents of the State.

Robert Paisola, CEO, of Western Capital Multimedia. along with our team of investigators, document FRAUD on a Nationwide Basis by Sky Las Vegas Board President M. Aaron  Yasopher.  The State of Nevada enjoins Sky Las Vegas from terminating disputed utility bills by owners.  Christine A. Gibbs tells the State of Nevada to Go to Hell and she is going to do what she is told to do by her Board of Directors, presided over by M. Aaron Yasopher as she requests Allied Barton Employee, Terry Zaslaw Security Chief to escort this reporter out of her office AFTER BEING NOTIFIED!

Here is a summary of the situation that was presented to the State of Nevada Utility Commission and The US Attorney.  This confirms the illegal conduct at SKY LAS VEGAS:  Data furnished to ABC NEWS by The Office of Michael J. Carano, Director of Tariff Enforcement, Nevada Power and The Office of The Attorney General, State of Nevada (Basic Legal Conclusions that will result in the Indictment of The Members of The Sky Las Vegas Board of Directors.)

SUMMARY
Is It Legal?

- Owners units usage was 29% of the total consumption of the entire building... but the owners reimbursed 53% of the costs (in 2009)!
- Owners are paying on average ~$28/month just for meter reading & customer charges! 
- Owners are paying a profit on their demand charges to the HOA.

Also the Developers who rent out 80 units like this setup because their tenants are funding HOA expenses. Prescott Management likes it because it gives them more money to spend - they over-staff & over-pay which leads to more burden profits to them. An audit of our books would be in order to see exactly where the money goes.   This story goes hand in hand with the criminal scheme that is being used around the nation by Board President M Aaron Ya

 Is our Master Meter Legal? Absolutely Not, This is a criminal Matter and Any person who has paid Sky Las Vegas for Utilities since the facility was opened is a victim, renter or owner, you will be represented in a criminal action against the Conspirators.

NAC 704.560  Restricted use of master meters. (NRS 703.025, 704.210)


     1.  Except as otherwise provided in subsection 2, the use of a master meter for a new building is prohibited if:

     (a) The building has more than one unit;

     (b) The occupant of each unit controls a portion of the electric energy used in the building; and

     (c) The long-run benefits of separate metering outweigh the costs of purchasing and installing separate meters.

     2.  Master metering is not prohibited if a new building is initially constructed as one unit and is later subdivided into several units and if the utility determines that individual metering of each unit is impractical or impossible.

     3.  A customer who desires to have a master meter installed in a new building has the burden of proving to the utility that master metering for the building should not be prohibited. If the customer is not satisfied with the utility's determination on the matter, he may file a complaint against the utility with the Commission pursuant to the Rules of Practice and Procedure before the Commission.

     4.  The utility shall file with the Commission and provide each customer who requests the installation of a master meter a written statement of the criteria which the utility uses in evaluating such a request.

The Sky Condom
iniums are master metered by NPC (Nevada Power) under rate schedule LGS-2 Primary and charges $291/month customer charge to the HOA which is paid by the owners in our HOA fees (average $.71/unit). The building's rates vary drastically by time and season. We are also charged demand fees as a commercial or industrial facility would be charged. We have 409 residential units and a few commercial spaces most of which are vacant. The master meter includes all building usage. Each owned unit has a separate meter to track that residents usage. The owners also pay their pro-rated share of the common area usage (hallways, cooling towers, lobby, etc.) based on the size of their unit.

AMPS (Accurate Metering Products, CA) reads the submeters at a cost to the HOA of 4400/month (Average ~$10/unit/month) - which is paid by the owners in our HOA fees. Each owner receives a monthly bill from AMPS for their individual usage, and is again charged a $17.10 NPC Customer charge - on top of the metering & NPC fees paid in our HOA fees. AMPS uses an NPC small commercial rate schedule that carries that fee in order to bill the owners. Sky owners are not customers of NPC, so this is a bogus charge imposed by AMPS and our HOA. The price for electrical consumption in KWHR is passed thru to the owners at the same rate as charged by NPC to the building (this part is OK).

It Gets Worse... The sum of all the demand charges imposed on individual owners is GREATER than the demand charged to the building. The reason for this is complicated, but it's due to "Demand Diversity". The net result is the HOA profits nicely from these additional demand and facility charges imposed on the owners.

BOTTOM LINE
