The Sub Metering Federal Lawsuit at Sky Las Vegas To Get Underway, Robert Paisola Reports Live

 THIS IS A COPY OF THE 2010 SKY LAS VEGAS FINANCIAL STATEMENT THAT WE PRESENTED TO ABC NEWS AND THE US ATTORNEY REGARDING  THE POWER SUB METERING ISSUE THAT IS HEREIN DESCRIBED IN DETAIL





Here is a summary of the situation that was presented to the State of Nevada Utility Commission and The US Attorney.  This confirms the illegal conduct at SKY LAS VEGAS:  Data furnished to ABC NEWS by The Office of Michael J. Carano, Director of Tariff Enforcement, Nevada Power and The Office of The Attorney General, State of Nevada (Basic Legal Conclusions that will result in the Indictment of The Members of The Sky Las Vegas Board of Directors.)

SUMMARY

Is It Legal?

- Owners units usage was 29% of the total consumption of the entire building... but the owners reimbursed 53% of the costs (in 2009)!
- Owners are paying on average ~$28/month just for meter reading & customer charges! 
- Owners are paying a profit on their demand charges to the HOA.

Where does the profit go?

Presumably into the HOA fund. This hidden profit means the HOA costs are much higher than currently being disclosed to owners. Also the Developers who rent out 80 units like this setup because their tenants are funding HOA expenses. Prescott Management likes it because it gives them more money to spend - they over-staff & over-pay which leads to more burden profits to them. An audit of our books would be in order to see exactly where the money goes.   This story goes hand in hand with the criminal scheme that is being used around the nation by Board President M Aaron Ya

 Is our Master Meter Legal? Absolutely Not, This is a criminal Matter and Any person who has paid Sky Las Vegas for Utilities since the facility was opened is a victim, renter or owner, you will be represented in a criminal action against the Conspirators.

NAC 704.560  Restricted use of master meters. (NRS 703.025, 704.210)



     1.  Except as otherwise provided in subsection 2, the use of a master meter for a new building is prohibited if:

     (a) The building has more than one unit;

     (b) The occupant of each unit controls a portion of the electric energy used in the building; and

     (c) The long-run benefits of separate metering outweigh the costs of purchasing and installing separate meters.

     2.  Master metering is not prohibited if a new building is initially constructed as one unit and is later subdivided into several units and if the utility determines that individual metering of each unit is impractical or impossible.

     3.  A customer who desires to have a master meter installed in a new building has the burden of proving to the utility that master metering for the building should not be prohibited. If the customer is not satisfied with the utility's determination on the matter, he may file a complaint against the utility with the Commission pursuant to the Rules of Practice and Procedure before the Commission.

     4.  The utility shall file with the Commission and provide each customer who requests the installation of a master meter a written statement of the criteria which the utility uses in evaluating such a request.

The Sky Condominiums are master metered by NPC (Nevada Power) under rate schedule LGS-2 Primary and charges $291/month customer charge to the HOA which is paid by the owners in our HOA fees (average $.71/unit). The building's rates vary drastically by time and season. We are also charged demand fees as a commercial or industrial facility would be charged. We have 409 residential units and a few commercial spaces most of which are vacant. The master meter includes all building usage. Each owned unit has a separate meter to track that residents usage. The owners also pay their pro-rated share of the common area usage (hallways, cooling towers, lobby, etc.) based on the size of their unit.

AMPS (Accurate Metering Products, CA) reads the submeters at a cost to the HOA of 4400/month (Average ~$10/unit/month) - which is paid by the owners in our HOA fees. Each owner receives a monthly bill from AMPS for their individual usage, and is again charged a $17.10 NPC Customer charge - on top of the metering & NPC fees paid in our HOA fees. AMPS uses an NPC small commercial rate schedule that carries that fee in order to bill the owners. Sky owners are not customers of NPC, so this is a bogus charge imposed by AMPS and our HOA. The price for electrical consumption in KWHR is passed thru to the owners at the same rate as charged by NPC to the building (this part is OK).

It Gets Worse... The sum of all the demand charges imposed on individual owners is GREATER than the demand charged to the building. The reason for this is complicated, but it's due to "Demand Diversity". The net result is the HOA profits nicely from these additional demand and facility charges imposed on the owners.

This was the text of a letter that was received today by a resident of the Sky Las Vegas.

We are now going to file a Federal Class Action Lawsuit against Sky Las Vegas once we confirm all of the details of this statement. If you have ever lived at the Sky las Vegas and paid a utility bill, you will be effected by this lawsuit.

Game on boys, and if you even try to terminate service to that unit, we will ensure that Nevada Power terminates the entire building.
